Terms of Use

Sideria (the "Service") is operated by Marcus DuPont, an individual based in New York, United States ("we," "us," "our"). These Terms of Use ("Terms") are a binding agreement between you and us governing your use of the Sideria app and related services. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use Sideria. By using the Service you represent that you are 13 or older and that the information you provide at sign-up, including your year of birth, is accurate. Where local law sets a higher minimum age for the kind of processing this Service involves, that higher age applies to you.

2. The Service

Sideria is a self-guided tool for tending habits, reflecting, and — if you choose — sharing quiet, anonymous solidarity or a shared habit with others. We may add, change, or remove features over time. We try to keep the Service available and dependable, but we do not guarantee it will be uninterrupted or error-free.

3. Your Account

You are responsible for keeping your account credentials secure and for activity that occurs under your account. Tell us promptly if you believe your account has been compromised. You may delete your account at any time from Settings; deletion is described in our Privacy Policy and is irreversible.

Sideria is a small, calm place. You agree not to:

We operate human-reviewed moderation of content that you send to other people. We may remove content, limit features, suspend, or terminate accounts that violate these Terms or that threaten the safety of others. Because habit names and your journal are private to you (and, in the case of the journal, never leave your device), our moderation reaches only the content you actively send to others — not your private practice.

5. Your Content

You retain ownership of the content you create in Sideria — your habits, reflections, and the data you generate. You grant us only the limited license necessary to operate the Service for you: to store, process, and display your content back to you and to the specific people you choose to share with. We do not sell your content, use it for advertising, or use it to train AI models. Our handling of your data is described in the Privacy Policy.

6. Supporter Subscription and Payments

Sideria offers an optional auto-renewing "Supporter" subscription, sold through Apple's In-App Purchase. The following terms apply:

Subscriptions purchased through Apple are also governed by Apple's standard End User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula. Supporting Sideria unlocks supporter features; the core practice of tending your habits does not require a subscription.

7. Not Medical or Clinical Advice

Sideria is a self-guided habit and reflection tool. It is not a medical device, and it does not provide medical, psychological, therapeutic, or clinical advice, diagnosis, or treatment. Its recovery, sobriety, and "witness" features are forms of personal reflection and peer solidarity — they are not professional care, supervision, sponsorship, or crisis intervention, and they are not a substitute for any of those.

Do not rely on Sideria for medical or mental-health decisions. If you are dealing with substance use, self-harm, or a mental-health crisis, please reach out to a qualified professional. In the United States, you can call or text 988 (Suicide & Crisis Lifeline) or call 911 in an emergency. Outside the U.S., contact your local emergency services or crisis line.

8. Intellectual Property

The Service itself — its software, design, artwork, sounds, and the name "Sideria" — belongs to us and is protected by intellectual-property law. These Terms do not grant you any right in the Service beyond the limited, personal, non-transferable license to use it as intended.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any data (including content kept only on your device) will be preserved or recoverable.

10. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the Service. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or US$50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

11. Indemnification

You agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of the rights of another person.

12. Suspension and Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if your conduct threatens the safety of others, or as necessary to comply with law. Sections that by their nature should survive termination — including content ownership, disclaimers, limitation of liability, and indemnification — survive.

13. Changes to These Terms

We may update these Terms from time to time. A material change will carry a clear summary and effective date. We will deliver that notice through the app and by email before the effective date when reasonably possible. The app will record your acknowledgment of the published version. Changes that require renewed consent will ask for affirmative acceptance.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Before bringing any formal claim, you agree to first contact us at the address below so we can try to resolve it informally. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in New York, and you and we consent to the jurisdiction of those courts.
